Phone call to Minister Conroys Office

Wednesday 11th February I called the Ministers Office to ask a few questions and was referred to his “Media Liaison” Tim Marshall. As with all phone calls these days we were both well aware that the call may be recorded for training and coaching purposes. (Got to love that standard line)

Really this guy should be called Mr Conroys own filter. One question from ten was answered and mostly all the responses from this guy were for me to provide my email to him.
Nevertheless I persisted in exposing him as a well trained circus chimp. (With all due respect afforded to well trained monkey acts now appearing in circuses nationwide)

(Got to love that standard line)"... um, no. Did you actually say explicitly that you were recording the conversation, and that you might publish or report upon that recording? If you didn't, then you just committed a crime.

"In some States and Territories, a party to the conversation may record the conversations without the other party's consent. You can't assume that because you're talking to a person whose job is "media advisor" they they have given informed consent to the recording. You HAVE to make it explicit -- which is why corporations have the standard message so you can hang up if you don't want to be recorded, or ask for the recording to be stopped.

While I haven't listened to all of the pieces you created, Tim Marshall is "just doing his job", and delivering whatever messages he's been instructed to by Senator Conroy. Recently it's been clear that there will be no conversation about any other questions relating to Internet "filtering" except to refer back to the statements. He, personally, is caught in a bind. I wouldn't like to have his job at the moment. And you're less likely to get answers from people if you attack them personally.

It also doesn't help to start committing crimes.

Erm Stilgherrian...

All the recorded message parts in the "hold line" about being recorded and "... I can hang up if I wish... " were edited out of the final mix because it went on for 5 minutes or so before I spoke with Tim Marshall, after speaking with the secretary.

I was advised on the during this original recording I have that the phonecall may be recorded whilst being re-directed during this time.

Time constraints on Youtube videos being only 10 minutes per video its not a great idea to have a full 5 mins of recorded message on a video clip.

Your suggestion that I have broken any kind of crime is ill-informed and pure wild assumption and speculation on your part.

Thanks for the advice anyway.  Nice to see you Registered just yesterday. Probably specifically to comment on my vid.

Thanks for taking the trouble. When I need legal advice in future remind me to run it past you again...

Oh yeah Stilgherrian and as far as "Just doing his job " goes..... Seems I recall that line being used in defense at Nuremburg.

That line doesn't work anymore in the 21st century.

Plenty of other nice cushy jobs for a tech guy like Timmy boy out there I am very sure.

Steve, that wasn't a personal attack, so I reckon your response is a little over the top in the sarcasm department.

I took your wording "As with all phone calls these days we were both well aware that the call may be recorded" as possibly meaning an explicit warning hadn't been given but assumed -- which is why I asked and used the word "if". With many people "doing media" for the first time these days, most of them not having formal media training, I thought it'd be useful to put the material online.

The "just doing his job" point re Tim Marshall has nothing to do with whether what he's doing is right or wrong. It's about choosing the best targets to attack. I don't think attacking Conroy's media advisor is time well spent, because he's not in a position to change policy.

Yes, I did register yesterday specifically to make my comment. Someone pointed out your post, I saw that you asked for comments, and to comment you have to register. And you registered on Friday, a full two days earlier. Your point is?
